Acknowledgment of Risks The Patron understands and acknowledges that kayaking involves inherent risks, including but not limited to capsizing, drowning, collision with other vessels, and exposure to the elements. The Patron voluntarily assumes all risks associated with the rental and use of the kayak. 2. Release and Waiver In consideration of the rental of the kayak and other good and valuable consideration, the Patron hereby releases, waives, discharges, and covenants not to sue the Company, its owners, employees, agents, and affiliates from any and all claims, demands, actions, or causes of action arising from or related to any injury, loss, or damage sustained while using the kayak, including those caused by the negligence of the Company. 3. Indemnification The Patron agrees to indemnify and hold harmless the Company from any claims, liabilities, damages, or expenses, including legal fees, arising out of the Patron's use of the kayak. 4. Compliance with Laws and Safety Rules The Patron agrees to comply with all local, state, and federal laws, as well as any safety rules provided by the Company. The Patron acknowledges that the Company has the right to terminate this Agreement and the rental if the Patron engages in unsafe practices or behavior. 5. Condition of Equipment The Patron acknowledges that they have inspected the kayak and associated equipment (including paddles, life jackets, etc.) and found it to be in good working condition. The Patron agrees to return the equipment in the same condition, normal wear and tear excepted. 6. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma. 7.
